The purpose of this article is to promote public safety, preserve residential neighborhoods, reduce damage to city streets, and minimize traffic hazards by regulating the operation and parking of large trucks, trailers, and buses on residential streets within the City of Wakefield.

For the purposes of this article, the following definitions shall apply:
(a) Bus: A large motor-driven passenger vehicle capable of carrying more than thirty-five (35) passengers at one time or having a Gross Vehicle Weight (GVW) in excess of 10,000 pounds, used for the transportation of persons for school, church, or other public purposes.
(b) Large Truck: A large motor-driven vehicle exceeding nine (9) feet in height, having more than a single rear axle, or having a Gross Vehicle Weight (GVW) in excess of 26,001 pounds.

In order to provide a safer environment and reduce damage to city streets, it shall be unlawful to operate or park any of the following vehicles on any residential street in a residentially zoned area within the city limits of Wakefield, Kansas:
Any vehicle with a Gross Vehicle Weight (GVW) in excess of 26,001 pounds; Any large truck; Semi-truck; Semi-trailer; Tractor trailer; Trailer; Tractor; Bus; RV.

The restrictions set forth in Section 11-503 shall not apply under the following circumstances:
(a) During the active loading or unloading of such vehicle, including but not limited to moving vans, delivery vehicles, or service vehicles conducting legitimate business at the location.
(b) When such vehicle is being used for routine or emergency maintenance of utilities, transportation facilities, or private property.
(c) When such vehicle is being used in the construction, repair, or improvement of utilities, transportation facilities, or private property.

(a) Any person, corporation, or other entity found guilty of violating the provisions of this article shall, upon first conviction, be subject to a fine of One Hundred Fifty Dollars ($150.00), plus applicable court costs.
(b) Subsequent violations may result in:
(1) Mandatory court appearance; and
(2) Increased fines or penalties as determined by the Municipal Court of the City of Wakefield.

This article shall be enforced by the City of Wakefield law enforcement officers or other authorized officials.
