Any property owner desiring to establish a curb line shall be required to obtain the authorization from the Governing Body.

Any person desiring to alter or change any existing curb or gutter within the City shall be required to obtain authorization from the Governing Body, and shall be required to give a performance bond, the form and amount to be determined by the Governing Body to insure the proper re-establishment of said curb and gutter in conformance with the authorization granted by the Governing Body.

Any person who shall trespass or injure any terrace, parking, shrubbery or trees upon any terrace or parking, or any person who shall alter, destroy or in any way damage existing curb or gutter, without compliance with the provisions of Sec. 10-202, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine not exceeding Five Hundred Dollars ($500), or be imprisoned for not more than thirty days (30), or both.
